Right of withdrawal, exceptions and attualfoto return policies

Subject to the exceptions noted below, you have the right to withdraw from your order, without giving any reason, within 14 days from the day you received the product you ordered (or the last product, lot or piece in the case of multiple goods, lots or pieces delivered separately). If you have instructed a person you trust to pick up the product, your right of withdrawal begins on the day the product is delivered to the person you designate, other than the carrier. In order to exercise the right of withdrawal, you must send the relevant notice before the expiration of the 14-day period.

Effects of exercising the right of withdrawal

We will reimburse you for all payments in connection with the product for which you have exercised your right of withdrawal, excluding shipping costs for the return of the item in question. You remain responsible for the shipment of the product until it is delivered to our offices at 8 Istria Street. We will make the refund on the same payment method you used to place the order. In any case, you will not incur any costs as a consequence of this refund. We may hold the refund until we receive the product. Please note that you are required to return the products to us within 14 days from the day you communicated your withdrawal, followed by registered mail with return receipt within 48 h after the communication. You will have to bear the direct costs of returning the products. You may be held liable for any diminution in the value of the goods resulting from the handling of the goods (other than that necessary to establish the nature, characteristics and functioning of the goods).

In the event of damage to the product during transport, we will notify you within 5 days of receipt to allow you to take action against the shipper. In this case, the withdrawal is considered canceled and the product will be returned to you again. We are not responsible for damage, theft, tampering or loss for goods returned by uninsured shipments.

The right of withdrawal lapses for lack of or damage to the original outer packaging or original packaging, lack of or damage to parts, accessories, manuals of the product or its damage due to causes other than transportation.

Exceptions to the right of withdrawal

All content featured on or made available through the Attualfoto Services in the form of text, graphics, logos, icon buttons, images, data compilations and software, is the property of Attualfoto or its content providers and is protected by the laws of Italy and international copyright and database rights laws. The list of all content present or made available through the Attualfoto Services is the exclusive property of Attualfoto. You may not systematically extract and/or reuse parts of the Services without the express written consent of Attualfoto. In particular, you may not use data mining, robots, or similar acquisition or extraction devices to extract (one or more times) for reuse any substantial part of any Service without our express written consent. Nor may you create and/or publish your own database that reproduces substantial portions (e.g., prices and product listings) of the Attualfoto Services without our express written consent.

Trademarks

The graphics, logos, page headers, icon buttons, fonts, and service marks included in or made available through any of the Services are trademarks or distinctive marks of Attualfoto. The trademarks and service marks of may not be used in connection with any product or service that is not Attualfoto's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Attualfoto.

Your Account

If you use the Attualfoto Services, you are required to keep your account and password confidential and to control access to your computer and, you agree to the extent permitted by applicable legal provisions, to be held responsible for all activities that occur under your account and password. You agree to take all necessary precautions to ensure that your password remains secure and confidential, and you agree to notify us immediately if you have reason to believe that any third party has knowledge of your password, or if your password is, or is allegedly about to be, used in an unauthorized manner. You are responsible for ensuring that the information you provide to us is correct and complete, and for notifying us immediately of any changes in the information you have provided to us. You will be able to access and update most of the information you provide in the My Account section of the site. You shall not use the Attualfoto Services: (i) in a manner that causes, or is likely to cause, disruption, damage or malfunction of the Services and its functionality, or (ii) for fraudulent purposes, or otherwise to commit unlawful activity, or (iii) to cause annoyance, harm or apprehension. We reserve the right to prevent access to the Site and/or the Services, to suspend or terminate an account, and to remove or modify Site content at our discretion, in the event of a violation of applicable law, these Terms of Use, or applicable guidelines or policies.

Our Responsibility.

We will do our best to ensure that access to the Attualfoto Services is provided without interruption and that transmissions occur without error. However, due to the nature of the Internet, uninterrupted access and error-free transmission cannot be guaranteed. In addition, your access to the Attualfoto Services may also be occasionally suspended or limited to allow for repair work, maintenance, or the introduction of new activities or services.

We will attempt to limit the frequency and duration of these suspensions and limitations. Attualfoto will not be liable for (i) losses that are not a result of our breach of these terms and conditions or (ii) any loss of business opportunity (including lost profits, revenue, contracts, deemed savings, data, goodwill, or unnecessarily incurred expenses) or (iii) any other indirect or consequential loss that was not reasonably foreseeable, either by you or by us, at the time you began using the Attualfoto Services. We will not be liable for any delay or failure to perform our obligations under these terms and conditions if the delay or failure results from unforeseeable circumstances or force majeure. This provision does not affect your rights under the law and in particular your right to receive the purchased goods within a reasonable time or to be reimbursed in the event of non-delivery due to circumstances arising out of unforeseeable circumstances or force majeure. The statutory provisions in force in some states may prohibit the limitations of liability now stated.

Service modifications or changes in terms and conditions

We reserve the right to change the Attualfoto Services, policies, these Terms of Use and the Terms of Service at any time to offer new products or services or to comply with legal and regulatory requirements. You will be subject to the policies and terms of the General Terms of Use in effect from time to time at the time you use the Attualfoto Services. If any provision of these terms is held invalid, void, or for any reason unenforceable, such condition shall not affect the validity and enforceability of the other provisions.

Waiver

If you fail to comply with these Terms of Use, our failure to exercise our right to take action against you does not constitute a waiver of our right to take action for breach of your obligations.
